This Privacy Statement ("Statement") describes the personal information we collect through our website, our partners’ websites, and associated mobile applications (collectively the "Application"), and how we collect and use it. The term "MQPONS" refers to MQPONS Inc., a Delaware corporation, and its various web, email and telephony services.
1 Information We Collect and How We Use It
Account information. We ask for and store information about you when you create an account on the Application, such as your name, email address, and signup location. We use your name to create your account name, and we use your signup location to help target the Application to the town you live in. We use your email address to send you updates, provide services to you in connection with the Application, and to contact you on behalf of other users sending you messages, complements, and the like. You can change your account information.

Public content. You can contribute to the Application in a number of different ways, including writing reviews, uploading photos, participating in talk threads, sending compliments, filling out your public profile, interacting with merchants through email or text messaging, and voting on other users' contributions. We may store these contributions (your "Public Content"), display them to other users, and use them for promotional purposes. Note that if you include personally identifiable information in your Public Content, it can be used and viewed by others. We are not responsible for the information you choose to include in your Public Content.

Messaging. The Application allows you to exchange text messages with others using the messaging feature and email. We may store these messages in order to deliver them and allow you to manage them. The Application also allows you to send information from the Application to your phone via text message. In order to carry out these requests, we may log your phone number, your carrier, and the date and time that the message was processed. Your carrier may charge you for texts that you receive. MQPONS will not refund, offset, or otherwise rebate any text message charges actually incurred by you in utilizing the Application or interacting with either MQPONS or vendors using the Application.

Online Sign-Up. By signing up on our Online Sign-up page or via response to a text message sent by MQPONS or the Application, you (the "subscriber") are subscribing to this distribution list(s) powered by MQPONS. You are also subscribing to the owner of this Online Sign-up page (also referred to as the "MQPONS user" or the "user"). By subscribing, you are allowing this user to send you messages via MQPONS service. To start receiving messages from this subscription, you must verify each contact information point that you would like to receive messages on. If you do not verify your contact information you will not receive messages from this subscription. Receiving mobile text messages from this user via MQPONS is completely FREE of charge. However, standard text messaging rates from your wireless carrier still apply. MQPONS will not refund, offset, or otherwise rebate any text message charges actually incurred by you in utilizing the Application or interacting with either MQPONS or vendors using the Application.
To unsubscribe or change your subscription settings, click on "Unsubscribe" link at the bottom of any email message you receive via MQPONS service.

Collected information. Your contact information is collected by MQPONS user on an opt-in basis and can be collected in two ways:

1. MQPONS user collects your name, mobile number, email address, password and other information when you subscribe to the user's Online Sign-up page.

2. MQPONS user can also collect your mobile number when you text the user's Mobile Keyword to MQPONS's short code.

MQPONS does not expose your direct contact information to MQPONS users (the owner of the Online Sign-up page or Mobile Keyword) unless we have explicit or implied consent from you. An explicit consent is when you (the "subscriber") leave a checkmark next to the permission statement that allows the owner of the Online Sign-up page to access your direct contact information or place a checkmark next to "Allow access to my contact information." option in Subscription Management page. If you do not wish to share your contact information, please make sure this option is checked OFF. If the checkmark is OFF, the MQPONS user is still able to send you messages via MQPONS service but is not able to view or export your contact information. An implied consent is when you (the "subscriber") text the MQPONS user's Mobile Keyword to MQPONS's short code. In this case, your mobile phone number will be shared with the owner of the Mobile Keyword. If you would like to change this implied permission to share, click on "Unsubscribe" link at the bottom of any email message you receive via MQPONS service.

MQPONS may use or disclose information about you, including your personal information, under the following circumstances:

· To enforce our Terms of Use or other legal agreements.
· To establish or exercise our legal rights or defend against legal claims.
· To provide you with products and services you request.
· For verification and authentication purposes in regards to requests or changes of any personal information or data related.
· To anticipate and resolve problems and conflicts with our products and services.
· For other purposes communicated to you at the time you provide or authorize the use of your information.
· To outsource any of the tasks referenced in this Privacy Policy, such as customer service.
· In response to a subpoena, court order, or other legal process.
· To a company controlled by, or under common control with, MQPONS for any purpose permitted by this Privacy Policy.
· When MQPONS believes such use or disclosure is (a) necessary in order to investigate, prevent, or take action regarding suspected illegal activities, fraud, or situations involving potential threats to the physical safety of any person, or (b) required by law.
· In the event of a merger, acquisition, consolidation, divestiture, or bankruptcy of MQPONS.

Location data. The Application can provide helpful information based on where you are. If you tell us where you are (e.g., by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based information and advertising. If you want to deactivate this feature, you can either reinstall the application or deactivate GPS on your mobile device. The Application also allows you to tell other users where you are, if you choose.

Third party services. We allow you to access third party services, such as Facebook and Twitter, to share your selected Public Content with those services, and import information about who you are connected with on those other services so you can connect with them on the Application. You can always opt out on your MQPONS account page. Some of those third party services may also provide us with information from your accounts there to enhance and personalize your use of this Application.

Feedback. You should feel free to give us feedback, register a complaint, or ask questions about the Application. We may store your communications, including any personal information you include in them, so that we can effectively respond to you.

Administration. We may use the information described above for routine administrative purposes, such as investigating abuses on the Application, responding to user inquiries and enforcing and applying our Terms of Service and Statement.

Data storage. We store data in the United States.

Credit Card Purchases. If you purchase business services or other MQPONS products online, we collect and store billing and credit card information. This information will only be shared with third parties who perform tasks (such as fulfilling orders and processing credit card payments) required to complete the purchase transaction. When you enter sensitive information (such as a credit card number) on our registration or order forms, we encrypt that information using 128-bit secure socket layer technology (SSL).
2 Transfer of Information
Public Content. If you post content for public view on the Application, we may distribute such Public Content to a wider audience by sharing it (or portions of it) with third parties so that they can publish it on their own websites and media platforms. We may ask them to credit you as the source of these contributions by including your account name and profile photo.

Third party service providers. We may use third parties to provide technical and customer support, perform tracking and reporting functions, conduct quality assurance testing, perform payment processing and provide other services in connection with the Application. We may share information about you with them so that they can perform the services they are required to perform, but they are not permitted to use your personal information other than to provide the services requested by you.

Aggregate information. We may share non-personal information in the aggregate to third parties relating to user behavior in connection with actual or prospective business relationship with those third parties, such as advertisers and content distributors. For example, we may disclose the number of users that have been exposed to, or clicked on, advertising banners.

Business transfers. We may share your information with our parent company, subsidiaries, joint ventures, or other companies under a common control that we may have now or in the future, in which case we will require them to honor this Statement. If another company acquires our company or all or substantially all of our assets, that company will possess your information, and will assume the rights and obligations with respect to that information as described in this Statement.

Investigations. We reserve the right to investigate abuses on the Application, and enforce and apply our Terms of Service and Statement. We may disclose information about you to third parties if we have a good faith belief that such disclosure is reasonably necessary to (a) take action regarding suspected illegal activities; (b) enforce or apply our Terms of Service and Statement; (c) comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; or (d) protect our rights, reputation, and property, or that of our users, affiliates, or the public.

The Application may contain links to third party websites with which we have no affiliation. Except as set forth herein, we do not share your personal information with those third parties, and are not responsible for their privacy practices. We suggest you read the privacy policies on all such third party websites.
4 Security
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

6 Modifications to this Statement
We may revise this Statement from time to time. The most current version of the Statement will govern our use of your information and will always be located in mqpons.com. If we make a change to this Statement that, in our sole discretion, is material, we will notify you either by prominently posting a notice of such changes prior to implementing the change on the Application and/or via the email associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Statement.
